Entitle Guard – Account Creation Terms of Use

By creating an account with Entitle Guard (“we”, “us”, “our”), you agree to be bound by the following terms and
conditions.
These terms govern your use of the Entitle Guard platform, services, and application ("the System").
1. User Agreement
- You are responsible for maintaining the confidentiality of your username and password.
- Any actions taken using your credentials—whether authorised or not—are your responsibility.
- We reserve the right to suspend or terminate your account without prior notice if we detect misuse or breach
of these terms.
2. Account Creation and Eligibility
- An Entitle Guard account is required to access and use the platform.
- To create an account, you must provide accurate and current personal information, including your name,
address, and a valid email address.
- You must use an email address that is exclusively accessible to you and not shared.
- Making false or misleading statements in the account creation process may constitute an offence under the
Crimes Act 1900 (NSW).
- You may request to deactivate your account at any time by contacting us in writing.
3. Platform Access and Usage
Once registered, you may access the Entitle Guard System using only the official interfaces and authentication
credentials assigned to you. Access must comply with these Terms of Use and all applicable laws.
You must not:
- Share or allow others to use your login credentials.
- Attempt to access another person’s account.
- Disrupt or interfere with the platform or its servers.
- Use automated tools (e.g., bots, scrapers) to extract data without permission.
- Circumvent or tamper with platform security or functionality.
- Reproduce or distribute any platform content without explicit written consent.
4. System Availability
- While we take reasonable measures to maintain platform availability, we do not guarantee uninterrupted or
error-free access.
- We may perform maintenance, updates, or improvements that temporarily affect access.
5. Disclaimer and Limitation of Liability
To the fullest extent permitted by law:
- We exclude liability for any loss or damage arising from:
- Errors or omissions in the System.
- Decisions made based on platform content.
- Personal injury, property damage, or third-party breaches.
- Server outages, data loss, malware, or unauthorised access.
- Where liability cannot be excluded (e.g., under Australian Consumer Law), it is limited to the extent
permitted.
You are solely responsible for ensuring your use of the System complies with applicable laws in your jurisdiction.
6. Indemnity
You agree to indemnify and hold harmless Entitle Guard, its employees, and agents against any claim, liability, or
cost (including legal fees) arising from:
- Your misuse of the platform.
- Your breach of these Terms.
- Any content or data you provide that causes harm or legal risk.
7. Privacy and Data Protection
- Your personal data will be handled in accordance with our Privacy Policy.
- We take all reasonable steps to:
- Protect the integrity and security of your information.
- Limit access to authorised personnel only.
- Monitor and audit internal access for compliance.
- Prevent unauthorised modification or corruption of your data.
